In addition to subpoenaing the organization he works for, Calvin claims that OpenAI subpoenaed him personally, with the sheriff\u2019s deputy asking for his private messages with California legislators, college students, and former OpenAI employees.<\/p>\n<p class=\"has-text-align-none\">\u201cI believe OpenAI used the pretext of their lawsuit against Elon Musk to intimidate their critics and imply that Elon is behind all of them,\u201d Calvin says. Last month, <a href=\"https:\/\/sfstandard.com\/2025\/09\/02\/openai-sam-altman-elon-musk-ai-regulation\/\" target=\"_blank\" rel=\"noopener\"><em>The<\/em> <em>San Francisco Standard<\/em> reported<\/a> that OpenAI had subpoenaed Encode AI to find out whether the group is funded by Elon Musk. OpenAI issued the subpoena as part of its <a href=\"https:\/\/www.theverge.com\/news\/646308\/openai-countersues-elon-musk\" target=\"_blank\" rel=\"noopener\">countersuit against Elon Musk, which <\/a>claims the billionaire has engaged in \u201cbad-faith tactics to slow down OpenAI.\u201d OpenAI <a href=\"https:\/\/techcrunch.com\/2025\/08\/21\/openai-lawyers-question-metas-role-in-elon-musks-97b-takeover-bid\/\" target=\"_blank\" rel=\"noopener\">also subpoenaed Meta<\/a> about its involvement with <a href=\"https:\/\/www.theverge.com\/news\/609685\/elon-musk-openai-purchase-offer\" target=\"_blank\" rel=\"noopener\">Musk\u2019s $97.4 billion takeover bid<\/a>.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">One Tuesday night, as my wife and I sat down for dinner, a sheriff\u2019s deputy knocked on the door to serve me a subpoena from OpenAI.<\/p>\n<p>I held back on talking about it because I didn&rsquo;t want to distract from SB 53, but Newsom just signed the bill so\u2026 here&rsquo;s what happened:<br \/>\ud83e\uddf5 <a href=\"https:\/\/t.co\/VnYCJYg2DH\" target=\"_blank\">pic.twitter.com\/VnYCJYg2DH<\/a><\/p>\n<p>\u2014 Nathan Calvin (@_NathanCalvin) <a href=\"https:\/\/twitter.com\/_NathanCalvin\/status\/1976649051396620514?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">October 10, 2025<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p class=\"has-text-align-none\">Encode advocates for safety in AI and recently <a href=\"https:\/\/encodeai.org\/new-open-letter-raises-the-pressure-on-openai-to-answer-key-questions-about-risks-to-its-nonprofit-mission\/\" target=\"_blank\" rel=\"noopener\">put together an open letter<\/a> that presses OpenAI on how it plans to preserve its nonprofit mission amidst its <a href=\"https:\/\/www.theverge.com\/openai\/661303\/openai-stays-nonprofit-sam-altman-employee-memo\" target=\"_blank\" rel=\"noopener\">corporate restructuring plans<\/a>. The organization also pushed for SB 53, the landmark AI bill in California <a href=\"https:\/\/www.theverge.com\/ai-artificial-intelligence\/787918\/sb-53-the-landmark-ai-transparency-bill-is-now-law-in-california\" target=\"_blank\" rel=\"noopener\">signed into law in September<\/a>, which compels large AI companies to reveal information about their safety and security processes.<\/p>\n<p class=\"has-text-align-none\">\u201cThis is not normal. OpenAI used an unrelated lawsuit to intimidate advocates of a bill trying to regulate them. While the bill was still being debated,\u201d <a href=\"https:\/\/x.com\/_NathanCalvin\/status\/1976649129179959304\" target=\"_blank\">Calvin said, adding that he didn\u2019t turn over any of the documents requested.<\/a><\/p>\n<p class=\"has-text-align-none\">When reached for comment, OpenAI pointed <em>The Verge<\/em> to <a href=\"https:\/\/x.com\/jasonkwon\/status\/1976762546041634878\" target=\"_blank\">a post from Aaron Kwon<\/a>, the company\u2019s chief strategy officer, saying: \u201cOur goal was to understand the full context of why Encode chose to join Elon\u2019s legal challenge.\u201d <a href=\"https:\/\/techcrunch.com\/2024\/12\/30\/nonprofit-group-joins-elon-musks-effort-to-block-openais-for-profit-transition\/\" target=\"_blank\" rel=\"noopener\">Encode backed Musk\u2019s efforts<\/a> to block OpenAI <a href=\"https:\/\/www.theverge.com\/2024\/3\/1\/24087473\/elon-musk-openai-lawsuit-nonprofit-mission\" target=\"_blank\" rel=\"noopener\">from becoming a for-profit<\/a> company last year. Kwon also adds that \u201cit\u2019s quite common for deputies to also work as part-time process servers.\u201d<\/p>\n<p class=\"has-text-align-none\">Tyler Johnston, the founder of the <a href=\"https:\/\/www.theverge.com\/openai\/688783\/the-openai-files-will-help-you-understand-how-sam-altmans-company-works\" target=\"_blank\" rel=\"noopener\">AI watchdog group The Midas Project<\/a>, similarly <a href=\"https:\/\/x.com\/TylerJnstn\/status\/1976686275404132388\" target=\"_blank\">reported that he and his organization<\/a> received subpoenas from OpenAI. Johnston said OpenAI asked for \u201ca list of every journalist, congressional office, partner organization, former employee, and member of the public\u201d that the organization has spoken to about OpenAI\u2019s restructuring.<\/p>\n<p class=\"has-text-align-none\">In an emailed statement to <em>The Verge<\/em>, The Midas Project chief of staff Jack Kelly pushes back on Kwon\u2019s response. \u201cKwon\u2019s comments about the subpoenas appear to justify them by stating that Encode was a party to the legal case,\u201d Kelly writes. \u201cHowever, The Midas Project received a similar subpoena despite us not being a party to the legal case.\u201d<\/p>\n<p class=\"has-text-align-none\">OpenAI\u2019s head of mission alignment, Joshua Achiam, <a href=\"https:\/\/x.com\/jachiam0\/status\/1976690339546112098\" target=\"_blank\">responded to Calvin\u2019s post on X<\/a>. \u201cAt what is possibly a risk to my whole career I will say: this doesn\u2019t seem great,\u201d Achiam wrote. \u201cWe can\u2019t be doing things that make us into a frightening power instead of a virtuous one. We have a duty to and a mission for all of humanity.
