Earlier this year, Apple sued leaker Jon Prosser alongside Michael Ramacciotti, alleging the two had a \u201ccoordinated scheme to break into an Apple development iPhone, steal Apple\u2019s trade secrets, and profit from the theft.\u201d However, in a new filing<\/a>, Ramacciotti \u201cdenies that he planned or participated in any conspiracy or coordinated scheme\u201d with Prosser\u201d and that, to the best of his recollection, any payment he received from Prosser \u201cwas paid after the fact and was not agreed to in advance of the actions and communications.\u201d<\/p>\n

Apple\u2019s lawsuit<\/a> accused Ramacciotti of accessing the development iPhone of former Apple employee Ethan Lipnik after using location tracking to determine when Lipnik \u201cwould be gone for an extended period.\u201d He then allegedly showed Prosser features of the yet-unreleased iOS 26 over a FaceTime call. But in his court filing, Ramacciotti \u201cadmits that he accessed Lipnik\u2019s Apple Development iPhone and conducted a FaceTime call with Prosser, and Prosser asked Defendant to show certain iOS features,\u201d though he \u201cdenies that he tracked Lipnik\u2019s location.\u201d<\/p>\n

According to Ramaccioti\u2019s filing, several weeks prior to that call, Lipnik had \u201csat down\u201d with Ramacciotti and \u201cswiped through\u201d new iOS features on that iPhone. Ramacciotti \u201cdid not fully appreciate the sensitivity of the development version of iOS on the Development iPhone\u201d because of Lipnik\u2019s \u201cwillingness\u201d to show the features to him.<\/p>\n

The lawyers say that Prosser offered Ramacciotti $650 \u201cat some point after the FaceTime call\u201d and that Ramacciotti \u201cdid not initiate communications with Prosser based on any promise by Prosser that he would specifically pay\u201d for the information. While Prosser did pay Ramacciotti the $650, Ramacciotti \u201cwasn\u2019t expecting any payment from Prosser.\u201d Ramacciotti claims he didn\u2019t know Prosser was taking a video of the call. He also \u201cdenies he remains in possession of any Apple trade secrets and denies having any additional recordings or other forms of Apple confidential information.\u201d<\/p>\n

Prosser and Apple didn\u2019t immediately reply to a request for comment.<\/p>\n

Prosser told The Verge<\/em> last week that Prosser has been in \u201cactive communication\u201d<\/a> with Apple over the lawsuit, but a few days later, the company Apple said that Prosser \u201chas not indicated\u201d<\/a> when he may respond to it. A clerk has entered a default against Prosser, meaning the case can move forward even though he hasn\u2019t responded, and Apple intends to file for a default judgment against Prosser.<\/p>","protected":false},"excerpt":{"rendered":"
