{"id":167,"date":"2025-05-17T19:07:05","date_gmt":"2025-05-17T15:07:05","guid":{"rendered":"http:\/\/www.actutech.app\/epic-asks-judge-to-make-apple-let-fortnite-back-on-the-us-app-store\/"},"modified":"2025-05-17T19:07:05","modified_gmt":"2025-05-17T15:07:05","slug":"epic-asks-judge-to-make-apple-let-fortnite-back-on-the-us-app-store","status":"publish","type":"post","link":"http:\/\/www.actutech.app\/en\/epic-asks-judge-to-make-apple-let-fortnite-back-on-the-us-app-store\/","title":{"rendered":"Epic asks judge to make Apple let Fortnite back on the US App Store"},"content":{"rendered":"<figure>\n<p><img decoding=\"async\" alt=\"Illustration of the App Store logo in front of a background of gavels.\" data-caption=\"Epic CEO Tim Sweeney. | \ufeffImage: Cath Virginia \/ The Verge\" data-portal-copyright=\"\ufeffImage: Cath Virginia \/ The Verge\" data-has-syndication-rights=\"1\" src=\"https:\/\/platform.theverge.com\/wp-content\/uploads\/sites\/2\/2025\/05\/STK468_APPLE_ANTITRUST_CVIRGINIA_C.jpg?quality=90&amp;strip=all&amp;crop=0,0,100,100\" \/><figcaption>Epic CEO Tim Sweeney. | \ufeffImage: Cath Virginia \/ The Verge<\/figcaption><\/p><\/figure>\n<p class=\"has-text-align-none\">Epic is asking District Judge Yvonne Gonzalez Rogers to order Apple to review \u2014 and approve if compliant with Apple\u2019s guidelines \u2014 Epic\u2019s submission of <em>Fortnite<\/em> to the US App Store in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.364265\/gov.uscourts.cand.364265.1568.0.pdf\" target=\"_blank\" rel=\"noopener\">new court filing<\/a>.\u00a0The company argues in the document that Apple\u00a0is once again in contempt of the judge\u2019s <a href=\"https:\/\/www.theverge.com\/news\/659246\/apple-epic-app-store-judge-ruling-control\" target=\"_blank\" rel=\"noopener\">April order<\/a> restricting it from rejecting apps over their use of outside payment links.<\/p>\n<p class=\"has-text-align-none\">In a <a href=\"https:\/\/cdn2.unrealengine.com\/05-15-25-letter-from-apple-14bad27bb985.pdf\" target=\"_blank\" rel=\"noopener\">letter from Apple<\/a> that Epic shared late Friday, Apple writes that it won\u2019t \u201ctake action on the Fortnite app submission until after the Ninth Circuit rules on our pending request for a partial stay of the new injunction.\u201d Epic claims the delay is retaliation for its legal fight with the company, and notes in its filing that Apple \u201cexpressly and repeatedly\u201d told it and the court that it would approve <em>Fortnite<\/em> if the app complied with Apple\u2019s guidelines, which it insists its current submission does.<\/p>\n<p class=\"has-text-align-none\">Following Gonzalez Rogers\u2019 decision in April, Epic said <a href=\"https:\/\/www.theverge.com\/news\/659271\/fortnite-ios-apple-app-store-us-return\" target=\"_blank\" rel=\"noopener\"><em>Fortnite<\/em> would return<\/a> to the US App Store. The company has since submitted the game twice, <a href=\"https:\/\/www.theverge.com\/news\/667206\/epic-submitted-a-new-version-of-fortnite-to-apple\" target=\"_blank\" rel=\"noopener\">most recently<\/a> to include content from an update to the EU version of the game. But instead of Apple approving <em>Fortnite <\/em>in the US, the game <a href=\"https:\/\/www.theverge.com\/news\/668232\/fortnite-ios-unavailable-worldwide-apple-epic\" target=\"_blank\" rel=\"noopener\">disappeared from the EU App Store<\/a>. <\/p>\n<p class=\"has-text-align-none\">Epic claimed that was because it can\u2019t release in the EU because of <a href=\"https:\/\/www.theverge.com\/news\/668232\/fortnite-ios-unavailable-worldwide-apple-epic\" target=\"_blank\" rel=\"noopener\">Apple\u2019s decision to block its US submission<\/a>. Apple said it had merely asked that it resubmit the app without including the US storefront, \u201cso as not to impact Fortnite in other geographies.\u201d But in a <a href=\"https:\/\/x.com\/EpicNewsroom\/status\/1923558197802971459\" target=\"_blank\">post announcing its new filing<\/a>, Epic claims that would mean it has to submit multiple versions of the app, which it says is against Apple\u2019s guidelines. <\/p>\n<p class=\"has-text-align-none\">Epic is asking that the court enforce its injunction, find Apple in contempt again, and require the company to \u201caccept any compliant Epic app, including <em>Fortnite<\/em>, for distribution on the U.S. storefront of the App Store.\u201d<\/p>\n<p class=\"has-text-align-none\">The hitch here is that throughout this case, Judge Gonzalez Rogers hasn\u2019t gone so far as to require <em>Fortnite<\/em>\u2019s return to the store, finding in her 2021 ruling that Epic had still <a href=\"https:\/\/www.theverge.com\/2021\/9\/12\/22667694\/epic-v-apple-trial-fortnite-judge-yvonne-gonzalez-rogers-final-ruling-injunction-breakdown#:~:text=Epic%20and%20Apple%E2%80%99s%20contract%20was%20valid%2C%20and%20Epic%20knowingly%20broke%20it\" target=\"_blank\" rel=\"noopener\">knowingly broken its developer agreement<\/a> with apple. <a href=\"https:\/\/9to5mac.com\/2025\/05\/16\/epic-asks-court-to-compel-apple-to-reinstate-fortnite-on-the-app-store\/\" target=\"_blank\" rel=\"noopener\"><em>9to5Mac<\/em> writes<\/a> that the judge would likely need to agree that Apple is once again in contempt of court, as she did in her April 30th ruling.\u00a0The difference between now and then \u2014 and what could work in Epic\u2019s favor \u2014 is just <a href=\"https:\/\/www.theverge.com\/news\/659246\/apple-epic-app-store-judge-ruling-control#:~:text=%E2%80%9CIn%20the%20end,convince%20him%20otherwise.%E2%80%9D\" target=\"_blank\" rel=\"noopener\">how annoyed she seemed with Apple<\/a> in the text of that ruling.<\/p>\n<p class=\"has-text-align-none\">Apple did not immediately respond to <em>The Verge<\/em>\u2019s request for
