White House Press Secretary Karoline Leavitt confirmed in a statement Tuesday that Trump will sign an executive order this week extending the deadline another 90 days, landing the new deadline in mid-September.<\/p>\n<p class=\"has-text-align-none\">The Trump administration will spend the next 90 days \u201cworking to ensure this deal is closed so that the American people can continue to use TikTok with the assurance that their data is safe and secure,\u201d Leavitt said.<\/p>\n<p class=\"has-text-align-none\">The extension, first signed on January 20th, theoretically offers legal cover for TikTok\u2019s US service providers who are subject to the <em>Protecting Americans from Foreign Adversary Controlled Applications Act <\/em>from the <a href=\"https:\/\/www.theverge.com\/2025\/1\/19\/24347325\/tiktok-service-providers-penalties-apple-google-orcale-trump\" target=\"_blank\" rel=\"noopener\">hundreds of billions in penalties<\/a> they could face for keeping the app online and in US app stores. But that legal cover was already shaky given that Trump\u2019s extensions are not codified into the law, which was passed overwhelmingly by a bipartisan vote in Congress, and upheld as constitutional by the Supreme Court.<\/p>\n<p class=\"has-text-align-none\">As <em>The Verge<\/em> previously reported, ByteDance and an Oracle-led coalition <a href=\"https:\/\/www.theverge.com\/command-line-newsletter\/644038\/trumps-tariffs-tiktok-deal-china-bytedance\" target=\"_blank\" rel=\"noopener\">had nearly hammered out a deal<\/a> in April, but Trump\u2019s tariffs abruptly blew up the tentative agreement. While trade tensions between the US and China have simmered down, there\u2019s been no recent news about resurrecting that deal or another one. Even when a sale seemed likely, it was unclear whether China would allow ByteDance to sell the valuable algorithm that powers TikTok\u2019s video recommendations.<\/p>\n<figure class=\"wp-block-pullquote\">\n<blockquote>\n<p>\u201cThe whole thing is a sham if the algorithm doesn\u2019t move from out of Beijing\u2019s hands\u201d<\/p>\n<\/blockquote>\n<\/figure>\n<p class=\"has-text-align-none\">Several lawmakers, including those who\u2019ve criticized a divest-or-ban law for TikTok and ByteDance, have warned that Trump\u2019s repeated extensions are untenable and illegal. After Trump\u2019s last extension in April, Senate Intelligence Committee Vice Chair Mark Warner (D-VA) <a href=\"https:\/\/www.theverge.com\/news\/643964\/tiktok-trump-ban-delay-warner-congress-response\" target=\"_blank\" rel=\"noopener\">told <em>The Verge<\/em><\/a> the move was \u201cagainst the law\u201d and said \u201cthe whole thing is a sham if the algorithm doesn\u2019t move from out of Beijing\u2019s hands.\u201d<\/p>\n<p class=\"has-text-align-none\">Even before the second extension, Sens. Ed Markey (D-MA), Chris Van Hollen (D-MD), and Cory Booker (D-NJ), who oppose a ban of TikTok, <a href=\"https:\/\/www.theverge.com\/news\/635019\/tiktok-ban-deadline-extension-trump-markey-van-hollen-booker\" target=\"_blank\" rel=\"noopener\">wrote Trump<\/a> that it would be \u201cunacceptable and unworkable for your Administration to continue ignoring the requirements in the law.\u201d They warned, \u201cany further extensions of the TikTok deadline will require Oracle, Apple, Google, and other companies to continue risking ruinous legal liability, a difficult decision to justify in perpetuity.\u201d\u00a0<\/p>\n<p class=\"has-text-align-none\">That\u2019s because TikTok service providers in the US can be fined for facilitating access to the app after the ban deadline, and Trump\u2019s extensions fall outside of the mechanisms allowed for in the law. So far, however, these companies appear to be relying on assurances from the administration that they won\u2019t be sued for keeping TikTok online, although it <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2025-02-14\/apple-to-restore-tiktok-to-us-app-store-following-justice-department-letter\" target=\"_blank\" rel=\"noopener\">reportedly took a letter from the US attorney general herself<\/a> to assuage Apple and Google\u2019s concerns.<\/p>\n<p class=\"has-text-align-none\">A court could evaluate whether Trump\u2019s actions are legal, but only if somebody sues to stop the extension \u2014 and so far, nobody has. Earlier this month, though, <a href=\"https:\/\/www.wired.com\/story\/google-tiktok-shareholder-lawsuit-ban\/\" target=\"_blank\" rel=\"noopener\">a Google shareholder filed a lawsuit<\/a> against the company for allegedly failing to share internal records about its decision to flout the law under the Justice Department\u2019s assurances. The same shareholder had already filed suit against the DOJ for allegedly failing to share information about its decision not to enforce the law against Apple and Google.<\/p>\n<p class=\"has-text-align-none\">While members of Trump\u2019s party generally haven\u2019t gone so far as to call his extensions illegal, a <a href=\"https:\/\/www.theverge.com\/news\/643964\/tiktok-trump-ban-delay-warner-congress-response\" target=\"_blank\" rel=\"noopener\">dozen House Republicans<\/a> said in a statement in April that \u201cany resolution must ensure that U.S. law is followed, and that the Chinese Communist Party does not have access to American user data or the ability to manipulate the content consumed by Americans.\u201d Sen. Josh Hawley (R-MO) told reporters that month that Trump \u201cought to enforce the statute and ban TikTok. This middle way, I don\u2019t think is viable.\u201d<\/p>\n<p class=\"has-text-align-none\">But it\u2019s not clear what would prevent Trump from approving indefinite extensions or a deal that doesn\u2019t meet the letter of the law.
