It\u2019s a way YouTube makes it harder to target kids with personalized ads. But rather than mark individual videos as either \u201cMade for Kids\u201d or \u201cNot Made for Kids,\u201d the FTC alleges, Disney left the default designation at the channel level, so any video uploaded to a \u201cNot Made for Kids\u201d channel would bear that \u201cNot Made for Kids\u201d label instead.\u00a0<\/p>\n<p class=\"has-text-align-none\">The result was that videos with content from kid-friendly movies like \u201cThe Incredibles,\u201d \u201cToy Story,\u201d and \u201cFrozen\u201d would be marked as \u201cNot Made for Kids,\u201d according to the government, circumventing YouTube\u2019s heightened restrictions, including allowing YouTube to autoplay other \u201cNot Made for Kids\u201d videos after the Disney ones finished. That resulted in Disney collecting information on kids and serving them targeted ads on videos that were technically designed at not for kids, the FTC alleges, in violation of the Children\u2019s Online Privacy Protection (COPPA) Rule, which requires parental consent to collect information on kids under 13.\u00a0<\/p>\n<p class=\"has-text-align-none\">YouTube <a href=\"https:\/\/www.theverge.com\/2019\/11\/13\/20963459\/youtube-google-coppa-ftc-fine-settlement-youtubers-new-rules\" target=\"_blank\" rel=\"noopener\">implemented the labeling system<\/a> after its own <a href=\"https:\/\/www.theverge.com\/2019\/9\/4\/20848949\/google-ftc-youtube-child-privacy-violations-fine-170-milliion-coppa-ads\" target=\"_blank\" rel=\"noopener\">2019 settlement<\/a> with the FTC over alleged violation of the COPPA Rule.\u00a0<\/p>\n<p class=\"has-text-align-none\">Disney should have known that some of its videos were marked incorrectly, the government alleges, since YouTube already told Disney in 2020 that it was labeling its videos incorrectly,\u00a0 changing the labels on over 300 of its videos from \u201cNot Made for Kids\u201d to \u201cMade for Kids\u201d at that time, according to the complaint. But Disney continued to upload videos with only the default designation at the channel level, the FTC says.<\/p>\n<p class=\"has-text-align-none\">Under the proposed settlement, Disney will pay a $10 million civil settlement, obtain parents\u2019 consent for collecting data from kids under 13 as required by law, and create a new program to review whether videos uploaded to YouTube should be marked as made for kids or not which it must maintain for the next ten years \u2014 unless YouTube comes up with its own system \u201cto determine the age, age range, or age category of all YouTube
