The company claims that the <a href=\"https:\/\/www.theverge.com\/2024\/5\/14\/24155321\/google-search-ai-results-page-gemini-overview\" target=\"_blank\" rel=\"noopener\">AI Overviews<\/a> that often appear at the top of search results leave users with little reason to click through to the source, hurting traffic and illegally benefitting from the work of its reporters.\u00a0<\/p>\n<p class=\"has-text-align-none\">While Penske Media is the biggest name to take on Google over its AI Overviews, it\u2019s not the first. Online education company <a href=\"https:\/\/www.theverge.com\/news\/619051\/chegg-google-ai-overviews-monopoly\" target=\"_blank\" rel=\"noopener\">Chegg sued Google<\/a> in February, as did a group of <a href=\"https:\/\/www.theverge.com\/news\/698486\/european-publishers-have-beef-with-googles-ai-overviews\" target=\"_blank\" rel=\"noopener\">independent publishers<\/a> in Europe. The News \/ Media Alliance has also spoken out about the feature, calling it the \u201c<a href=\"https:\/\/www.theverge.com\/news\/672132\/news-media-alliance-google-ai-mode-theft\" target=\"_blank\" rel=\"noopener\">definition of theft<\/a>\u201d and seeking action from the DOJ.\u00a0<\/p>\n<p class=\"has-text-align-none\">Google spokesperson Jos\u00e9 Casta\u00f1eda defended the summaries to the <a href=\"https:\/\/www.wsj.com\/tech\/ai\/rolling-stone-publisher-sues-google-over-ai-summaries-3afde408\" target=\"_blank\" rel=\"noopener\"><em>Wall Street Journal<\/em><\/a> saying, \u201cwith AI Overviews, people find search more helpful and use it more.\u201d But Penske and other publishers say there is little reason to follow the links provided in search results and, as a result, they have seen <a href=\"https:\/\/www.wsj.com\/tech\/ai\/google-ai-news-publishers-7e687141?mod=article_inline\" target=\"_blank\" rel=\"noopener\">significant drops in traffic and revenue<\/a>. Penske claims in the suit that revenue from affiliate links is down by over 1\/3 this year, and it attributes that directly to a drop in traffic from Google.<\/p>\n<p class=\"has-text-align-none\">The company also claims it\u2019s in a tough situation. It can either block Google from indexing its content, essentially removing itself from all search results, which would further devastate its business. Or, it can continue to provide training material to Google for its AI, \u201cadding fuel to a fire that threatens PMC\u2019s [Penske Media Corporation] entire publishing business,\u201d the complaint states, according to the <em>Wall Street Journal<\/em>.<\/p>\n<p class=\"has-text-align-none\">This is, of course, just the latest battle between AI companies and the creators of the content they harvest. <a href=\"https:\/\/www.theverge.com\/news\/777344\/perplexity-lawsuit-encyclopedia-britannica-merriam-webster\" target=\"_blank\" rel=\"noopener\">Encyclopedia Britannica and Merriam-Webster<\/a> recently sued Perplexity, as did <a href=\"https:\/\/www.theverge.com\/2024\/10\/21\/24275924\/news-corp-wall-street-journal-perplexity-lawsuit-copyright-infringement\" target=\"_blank\" rel=\"noopener\">News Corp<\/a> last year. Meanwhile Microsoft and OpenAI have found themselves in the crosshairs of the <a href=\"https:\/\/www.theverge.com\/2023\/12\/27\/24016212\/new-york-times-openai-microsoft-lawsuit-copyright-infringement\" target=\"_blank\" rel=\"noopener\">New York Times<\/a>, the <a href=\"https:\/\/www.theverge.com\/2024\/4\/30\/24145603\/ai-openai-microsoft-new-york-daily-news-sue-copyright\" target=\"_blank\" rel=\"noopener\">New York Daily News, the Chicago Tribune<\/a>, and others. Google might also have a tougher time defending itself now that it\u2019s been forced to admit that \u201c<a href=\"https:\/\/www.theverge.com\/news\/773928\/google-open-web-rapid-decline\" target=\"_blank\" rel=\"noopener\">the open web is already in rapid decline<\/a>,\u201d as it faces multiple <a href=\"https:\/\/www.theverge.com\/news\/650665\/google-loses-ad-tech-antitrust-monopoly-lawsuit\" target=\"_blank\" rel=\"noopener\">antitrust<\/a><a href=\"https:\/\/www.theverge.com\/23869483\/us-v-google-search-antitrust-case-updates\" target=\"_blank\" rel=\"noopener\"> <\/a><a href=\"https:\/\/www.theverge.com\/23869483\/us-v-google-search-antitrust-case-updates\" target=\"_blank\" rel=\"noopener\">complaints<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Disclosure: Penske Media Corporation is an investor in Vox Media, The Verge\u2019s parent company.
